1. Provider and scope
These terms apply to the use of Elija OS, offered by Almos Alexander Pocs, Pfarrer-Ludwig-Weg 5, 86919 Utting am Ammersee, Germany (hi@elija.life).
2. Service
Elija OS is a web application for visual day planning, documentation and AI-assisted support in family life. The scope of functions follows the product description as published at the time. We develop the app continuously; improvements and changes to individual features are part of the service.
3. Formation of contract
The contract is concluded when your registration or order is confirmed. You must be of legal age.
4. Prices, fish and payment
Access is offered as a paid package. AI work is billed from a credit balance ("fish") at fixed prices — 1 fish equals 10 cents in value. Credit does not expire over time. Fish are compute credit for use inside the app: not a means of payment, not a cryptocurrency, and not transferable to third parties. All prices include statutory VAT where applicable.
5. Right of withdrawal for consumers
Consumers have a 14-day right of withdrawal. Details and a model form are on the "Withdrawal" page.
6. Your obligations
You are responsible for the accuracy of your details, for keeping your credentials confidential, and for collecting the child's data lawfully. Misuse, automated scraping, circumventing usage limits and uploading unlawful content are prohibited.
7. Availability
We aim for high availability but do not warrant a specific uptime. Maintenance windows and outages at individual third parties (e.g. AI models) may temporarily limit use. The core plan remains readable on the device even offline.
8. Not a medical device, not an emergency system
Elija OS does not replace medical, therapeutic or nursing care and is not intended for emergencies or life-sustaining monitoring. The app's prompts are suggestions; the decision always remains yours.
9. Liability
We are liable without limitation for intent and gross negligence and for injury to life, body or health. For slight negligence we are liable only for breach of a material contractual duty and limited to foreseeable damage typical of this type of contract. Liability under the German Product Liability Act remains unaffected.
10. Termination
The contract can be terminated at any time with effect from the end of the current billing period — directly in the app under Settings. After termination you can export your data; it is then deleted.
11. Changes and final provisions
We announce changes to these terms at least 30 days in advance by email. German law applies; for consumers the protective provisions of their country of residence remain unaffected.
